Terms of use
1. About these terms
This Website is operated by Pathfinder Media GmbH ("we", "us", "the Operators"). Our full company details are set out in our Imprint.
These Terms of Use govern your use of the Website. By using the Website, creating an account, or submitting any content, you agree to be bound by them. If you do not agree, please do not use the Website.
These Terms of Use, our Privacy Policy and our Community Guidelines, which are hereby incorporated by reference, contain the entire agreement between you and the Operators with respect to the Website. Any rights not expressly granted herein are reserved.
We may update these Terms from time to time. Where a change is material, we will give notice on the Website before it takes effect. Your continued use of the Website after a change takes effect constitutes acceptance of the revised Terms. If you do not accept a change, you may close your account and stop using the Website.
2. Accounts
Some features of the Website require an account. You are responsible for the accuracy of the information you provide, for keeping your credentials secure, and for all activity that takes place under your account. Notify us promptly if you believe your account has been accessed without your authorisation.
You may not impersonate any other person, create an account on behalf of someone else without their permission, or create a new account in order to evade a restriction, suspension or ban.
You may close your account at any time. The consequences of closure for your personal data are described in our Privacy Policy.
3. Permitted and prohibited uses
You may not use the Website in violation of any applicable law.
You may not upload or transmit any material that infringes or misappropriates any person's copyright, trade mark, trade secret or other right, or disclose through the Website any information the disclosure of which would breach a confidentiality obligation you are under.
You may not upload viruses, worms, Trojan horses or other harmful code, attempt to gain unauthorised access to the Website or its systems, subject our network or servers to unreasonable traffic loads, scrape the Website by automated means without our permission, or otherwise engage in conduct that disrupts the ordinary operation of the Website.
You may not communicate on or through the Website any unlawful, harmful, threatening, abusive, harassing, defamatory, obscene, hateful, fraudulent or sexually explicit material, or any material that encourages conduct that would constitute a criminal offence or give rise to civil liability. Our Community Guidelines set out in detail what is and is not permitted, and form part of these Terms.
You may not compile or use other users' personal information — including names, addresses, telephone numbers, email addresses or other contact details appearing on the Website — for the purpose of building marketing or mailing lists, sending unsolicited marketing material, or distributing that information to third parties. We treat any such activity as a material breach of these Terms and may suspend or terminate your access without notice. Where the conduct may also breach applicable law, we may report it to the competent authorities and will cooperate with any investigation.
4. Your contributions
Any material you transmit or post to the Website — including builds, build names and descriptions, wiki edits, guides, profile text and uploaded images ("Contributions") — will be treated as non-confidential. Please do not send us confidential or proprietary information through the Website.
You keep ownership of your Contributions. By submitting a Contribution you grant us a non-exclusive, worldwide, royalty-free, transferable and sublicensable licence to host, store, reproduce, adapt, publish, translate and display that Contribution for the purposes of operating, improving and promoting the Website. This licence continues for as long as the Contribution remains published on the Website, and thereafter only to the extent necessary for our back-ups, moderation records and the defence of legal claims.
You confirm that each Contribution is your own work or that you otherwise have the right to submit it, and that it does not infringe the rights of any third party. If you created material in the course of employment or study, please make sure you hold the necessary rights before submitting it.
5. Moderation, reporting and appeals
We screen user submissions automatically at the point of submission and review all user submissions. Publication is not approval: content that is already visible remains subject to review and removal. We may edit or remove content, and restrict, suspend or terminate accounts, in accordance with our Community Guidelines.
If you believe content on the Website breaches these Terms or our Community Guidelines, please report it by email to moderation.remove-this@nospam.gameslantern.com or through our Discord community, including a link to the content and a description of the problem. We will consider every report we receive and act on it where it is justified.
Where we remove your content or restrict your account, we will tell you and give our reasons, unless we are prevented from doing so by law. You may appeal by email to moderation.remove-this@nospam.gameslantern.com within 30 days. Appeals are considered by someone other than the person who made the original decision, and we aim to respond within five business days. Nothing in these Terms limits your right to pursue a complaint through any other route available to you under applicable law.
6. Our content and third-party rights
The Website is not endorsed by or affiliated with any game or software company. Game assets, images and trade marks referred to on the Website remain the property of their respective owners and are used for the purpose of identification and reference.
If you believe that material published on the Website infringes your copyright or that of another, please contact us via Discord or email moderation.remove-this@nospam.gameslantern.com , identifying the material, its location on the Website, and the right you say has been infringed.
7. Links to other materials
The Website may contain links to sites operated by independent third parties. These links are provided for convenience and reference only. We do not control those sites and are not responsible for their content. A link should not be read as an endorsement or sponsorship. If you choose to visit a linked site, you do so at your own risk.
8. Availability, and our liability
We provide the Website free of charge and make no guarantee that it will be available without interruption or free of errors. We may change, suspend or discontinue any part of the Website.
Information published on the Website, including game data, guides and user contributions, is provided for general information. We take reasonable care but do not warrant that it is accurate, complete or current.
We are liable without limitation for damage arising from injury to life, body or health, for damage caused intentionally or by gross negligence, and under the German Product Liability Act. Where we negligently breach an obligation that is essential to the proper performance of this agreement and on which you may reasonably rely, our liability is limited to the damage typically foreseeable for this type of agreement. Any further liability is excluded. Your mandatory statutory rights are not affected.
9. Termination
These Terms remain in effect until terminated. You may end them at any time by closing your account and ceasing to use the Website. We may suspend or terminate your access, in whole or in part, where we have reasonable grounds to believe that your use breaches these Terms or applicable law, or is harmful to other users, to third-party rights, or to the operation of the Website. Where we do so we will give you our reasons, and you may appeal as described in section 5.
10. Governing law
These Terms are governed by the law of the Federal Republic of Germany, excluding its conflict of law rules and the UN Convention on Contracts for the International Sale of Goods. Where you are a consumer habitually resident in another country of the European Union, this choice of law does not deprive you of the protection of mandatory provisions of the law of that country.
11. Severability
If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.
